These Terms and Conditions govern the use of studio space, equipment and media production services provided by Mic Check Studios. By booking or using any of our services, the client agrees to be bound by these terms.
1. Definitions
1.1 Mic Check Studios: Mic Check Studios Limited, the company providing podcast studio hire, editing and media production services.
1.2 Client: any individual, group or organisation using the services of Mic Check Studios.
1.3 Editing-Only Client: a client who uses Mic Check Studios for editing or post-production services without a studio booking.
1.4 Studio: the facilities, equipment and rooms provided by Mic Check Studios for recording and production, including the Blue Podcast Studio and the Content Room.
1.5 Content: any audio, video, images or other material recorded, supplied, produced or edited in connection with our services, whether raw footage or finished output.
2. Bookings
2.1 Booking Duration: all bookings are made in one-hour slots, with a minimum booking of one hour.
2.2 Advance Booking: bookings must be made in advance and are subject to availability.
2.3 Confirmation: a booking is confirmed only once Mic Check Studios has provided written acknowledgement or received payment.
2.4 Cancellations: cancellations made at least 48 hours before the scheduled start time will receive a full refund. Cancellations made less than 48 hours in advance will incur a charge of 50% of the booking fee.
2.5 Rescheduling: bookings may be rescheduled with at least 24 hours' notice, subject to availability.
2.6 No-Shows: if a client fails to attend a paid, confirmed booking without giving at least 24 hours' notice, the full booking fee is forfeited and the session will not be rescheduled free of charge.
3. Studio Viewing and Consultation Deposit
3.1 A £20 deposit is required to confirm any studio viewing or initial consultation. The deposit must be paid in advance via the payment link provided, and the appointment is not confirmed until the deposit has been received and acknowledged.
3.2 The deposit is not an additional fee. It will be deducted from the client's first paid booking with Mic Check Studios.
3.3 To retain the deposit, cancellations or rescheduling must be made at least 24 hours in advance.
3.4 The deposit is non-refundable if the client fails to attend without prior notice. Arriving more than 15 minutes late without informing us may be treated as a no-show.
3.5 By paying the deposit, the client agrees to these Terms and Conditions.
4. Payments
4.1 Studio Bookings: full payment is due before the start of the session, using the payment methods specified by Mic Check Studios.
4.2 Editing-Only Services: payment terms for editing-only clients are set out in Section 5.
4.3 Additional Charges: additional services or time beyond the booked duration will be charged. Where a session runs over, the full additional hour will be charged.
4.4 Payments to Mic Check Studios Only: all payments must be made directly to Mic Check Studios through our approved payment methods. We do not authorise, and accept no responsibility for, any payment or financial arrangement made with individual staff members outside of these terms.
5. Editing-Only Services
This section applies to editing-only clients.
5.1 Payment: full payment is required before editing begins. Work will not start until payment has been received and confirmed.
5.2 Supply of Materials: the client is responsible for supplying all footage, audio and assets in a usable format, together with any brief or instructions. Turnaround will not begin until all materials have been received.
5.3 Turnaround: the first edit will be delivered within 3 to 5 working days from the later of payment being received or all materials being supplied, unless otherwise agreed in writing.
5.4 Revisions: two rounds of revisions are included. All changes for each round should be submitted together in a single message. Further revisions may incur an additional charge.
5.5 Approval: if the client does not respond to a delivered edit within 30 days, the project will be considered approved and closed.
5.6 Cancellations and Refunds: payment is fully refundable if the project is cancelled before editing begins. Once editing has started, payments are non-refundable.
5.7 Supplied Materials: the client confirms they own, or have permission to use, all materials supplied. Section 8 (Content Responsibility and Ownership) applies in full. Supplied files will be retained for 14 days after the project is closed and may then be permanently deleted.
6. Studio Use
6.1 Access: clients will be given access to the studio 10 minutes before the start of their session for setup, and must vacate the studio promptly at the end of their booked time.
6.2 Equipment: use of studio equipment is included in the booking fee. All equipment must be handled with care.
6.3 Studio Technician: a technician will be present during sessions to assist with setup, troubleshooting and basic equipment operation.
7. Damage, Equipment and Cleanliness
7.1 Damage: clients are responsible for any damage to the studio, its equipment or facilities caused by misuse or negligence during their session. Mic Check Studios will notify the client of any repair or replacement cost in writing within 5 working days, with supporting evidence (such as photos or a repair quote) available on request. Reasonable wear and tear is not chargeable.
7.2 Cleanliness: clients must leave the studio clean and tidy. A cleaning fee of £25 may be charged if the studio is left in disarray.
8. Content Responsibility and Ownership
8.1 Content Liability: Mic Check Studios is not liable for any content recorded, supplied or produced by the client. Clients are responsible for ensuring their content does not infringe copyright or contain defamatory, illegal or offensive material.
8.2 Ownership: the client retains ownership of all original content they create or supply. Mic Check Studios claims no ownership over client content.
8.3 Edited Deliverables: where Mic Check Studios provides editing services, ownership of the final edited deliverables transfers to the client upon full payment. Mic Check Studios may use excerpts of the work in its portfolio and marketing unless the client opts out in writing.
8.4 Indemnity: the client agrees to indemnify Mic Check Studios against any claims, losses or damages arising from their content, including claims of copyright infringement, defamation or breach of third-party rights.
8.5 Right to Refuse: Mic Check Studios reserves the right to refuse service for content it considers inappropriate, offensive or unlawful.
9. File Delivery and Data Retention
9.1 Raw Footage: raw recordings from studio sessions are retained for 14 days after the session to allow for editing and review, after which they may be permanently deleted unless otherwise agreed in writing.
9.2 Editing Turnaround (Studio Clients): edited content from studio sessions will be delivered within 5 to 10 working days of the session date, unless otherwise agreed. Two rounds of revisions are included; further revisions may incur an additional charge. Turnaround for editing-only clients is set out in Section 5.
9.3 Client Response: if a client does not respond to a delivered edit or revision within 30 days, the project will be considered approved and closed. Further changes may incur a new charge.
9.4 Data Loss: Mic Check Studios takes reasonable care to back up recordings but is not liable for loss of footage due to technical failure, file corruption or events outside its reasonable control.
10. Health and Safety
10.1 Clients must follow all health and safety guidance provided by the studio. The studio is a smoke-free and drug-free environment.
10.2 Mic Check Studios is not responsible for injury, loss or damage to personal property on the premises, except where caused by the negligence of Mic Check Studios or its staff. Clients are responsible for keeping their belongings secure.
11. Limitation of Liability
11.1 To the fullest extent permitted by law, the total liability of Mic Check Studios arising from any booking or project, whether in contract, tort or otherwise, is limited to the fees paid by the client for that booking or project.
11.2 Mic Check Studios is not liable for any indirect, consequential or special losses, including loss of profits, loss of opportunity or reputational harm.
11.3 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited by law.
12. Force Majeure
Mic Check Studios is not liable for any failure or delay in performing its obligations caused by circumstances beyond its reasonable control, including power outages, building access issues, illness, equipment failure or events affecting the premises. Where possible, affected bookings or projects will be rescheduled at no additional cost.
13. Privacy
13.1 Data Collection: Mic Check Studios collects personal information such as names, contact details and payment information to manage bookings and services, in accordance with UK GDPR and the Data Protection Act 2018.
13.2 Use of Data: personal data is processed on the basis of contractual necessity to manage bookings, payments and client communications. It will not be shared with third parties except where required to deliver our services (such as payment processors) or where required by law.
13.3 Retention: personal and booking data is kept only as long as necessary for these purposes and to meet legal or accounting obligations, typically no longer than 6 years.
13.4 Your Rights: clients may request access to, correction of or deletion of their personal data, subject to our legal retention obligations, by contacting Mic Check Studios directly.
13.5 Livestreaming: clients must notify the studio in advance if they intend to livestream or broadcast a session.
14. General Terms
14.1 Compliance: clients must follow all reasonable instructions given by Mic Check Studios staff.
14.2 Governing Law: these terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
14.3 Amendments: Mic Check Studios may amend these terms at any time. Clients will be notified of any material changes before their next booking or project.
14.4 Severability: if any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
By booking or using the services of Mic Check Studios, clients agree to these Terms and Conditions.
